The President of the Court of Appeal, Justice Ayo
Salami, on Monday broke his silence on the report of the National
Judicial Council which asked him to apologise to the Chief Justice of
Nigeria, Justice Aloysius Katsina-Alu.
He has therefore sued the CJN and 10 others at a Federal High Court, Abuja, praying it to set aside the decisions of the National Judicial Council that set up two panels on the issue.
Salami’s action came in the wake of the expiration of the seven-day deadline given him to apologise to Katsina-Alu in writing on Tuesday(today).
Joined as Katsina-Alu’s co-defendants in the suit are the NJC, Justice Dahiru Musdapher, Katsina-Alu, Justice Umaru Abdullahi, Justice Emmanuel Ayoola, Justice Dominic Edozie, Justice Michael Akpiroroh, Mrs. Rakia Ibrahim, Justice Ibrahim Ndahi Auta, Justice Kate Abiri and Justice Peter Umeadi.
The Appeal Court President has enlisted the services of three Senior Advocates of Nigeria, comprising Chief Akin Olujinmi, Rickey Tarfa and Chief Adeniyi Akintola as his counsel in the case.
Salami and Katsina-Alu had been embroiled in a face-off following the alleged “arrest” of the Sokoto Election Appeal judgment on the gubernatorial election.
In his original affidavit in court when the face-office went public, Salami had alleged “that the 3rd Defendant (Katsina-Alu) had invited me to his office on the 8th of February, 2010 and directed me to ensure that the Sokoto appeal is dismissed, or that the panel be disbanded.”
But the CJN claimed that he had summoned Salami to his office in response to a petition written against him, which alleged that the judgment to be delivered by the Sokoto appeal had leaked.
However, Salami asserted that “As at the 8th day of February, 2010 when I was summoned by the 3rd Defendant, no petition had been written. The petition only surfaced on 15th day of February, 2010 after I had refused to carry out the unconstitutional directive of the 3rd Defendant.”
